Terms of Use

The short version. Use Magic Tutor to learn, not to cheat or to harm anyone. Lessons are written by AI, so check anything that matters before you rely on it in an exam.
The free plan has daily limits. Pro is a subscription that renews by itself until you cancel it, which you do in your Apple or Google account, not with us.
You can stop using Magic Tutor and delete your account whenever you like.
1. Who these terms are with
These Terms of Use are an agreement between you and Magic Tutor AI ("Magic Tutor", "we", "us"), the provider of the Magic Tutor website and mobile apps. We are based in the Kurdistan Region of Iraq. You can reach us at support@magictutor.ai.
By creating an account or using Magic Tutor, you agree to these terms. If you do not agree, please do not use the service.
2. Who may use Magic Tutor
You must be at least 13 years old. If you are under the age of digital consent in your country — 16 in parts of the European Union — you need permission from a parent or guardian, and they agree to these terms on your behalf.
You may not use Magic Tutor if you are barred from doing so under the laws of your country, or under the export and sanctions rules described in clause 14.
3. Your account
You sign in with Google or Apple. Keep that account secure — anyone who can reach it can reach your Magic Tutor account. Tell us at support@magictutor.ai if you think someone else is using your account.
One person, one account. Do not share your account or sell access to it.
4. How you may use it
Magic Tutor is for studying. You agree not to:
- upload anything you have no right to upload, or anything unlawful, hateful, or sexual
- photograph other people's private documents, or anyone's personal information, and send it through the service
- use the service to cheat where your school or examiner forbids it — that is between you and them, but we will not help you hide it
- resell, redistribute or republish generated lessons as your own product
- use bots, scripts or automated tools against the service, or try to get around the free-plan limits
- attempt to break, overload, reverse-engineer or gain unauthorised access to any part of the service
If you break these rules we may limit or close your account.
5. Lessons are written by AI
Magic Tutor uses AI models to read your pages and write your lessons. This matters, so please read it carefully:
- Lessons can be wrong. AI misreads handwriting, misunderstands diagrams, and sometimes states things confidently that are not true.
- Check anything important. Before an exam, or where a mistake would cost you, check the lesson against your textbook or your teacher.
- Magic Tutor is a study aid. It is not a teacher, and it is not professional advice of any kind — not medical, legal, financial or safety advice.
We do not promise that any lesson is accurate, complete or suitable for your syllabus.
6. Your content
What you upload stays yours. You give us permission to process it only so far as we need to in order to build your lesson and run the service — which means sending it to our AI provider, and storing the resulting lesson for you. We do not use your schoolwork to train AI models and we do not sell it. See the Privacy Policy for what is stored and for how long.
If you choose to share a lesson with a link, anyone with that link can read that lesson. Sharing is always your choice.
7. Our content
The Magic Tutor name, logo, app, website, design and software are ours and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own studying. Nothing else is granted.
8. The free plan
Magic Tutor is free to start. New accounts get a pool of free lessons, after which the free plan allows a limited number of lessons each day and a limited number of pages per upload. The app shows you what you have left and when it resets. We may change these limits, and will show the current limits in the app.
9. Magic Tutor Pro subscriptions
Pro is an auto-renewing subscription offering more lessons per day, more pages per upload, and additional study features described in the app at the time you subscribe.
Plans and price
Pro is offered as a monthly and an annual plan. Prices differ by country and are always shown in your local currency on the subscription screen before you buy. The price you see there, at the moment of purchase, is the price that applies.
Free trial
Where a free trial is offered, its length is shown on the subscription screen before you buy. If you cancel before the trial ends you are not charged. If you do not cancel, the subscription begins and you are charged automatically at the end of the trial. If you subscribe while a free trial is still running, any unused part of that trial is forfeited.
Payment and renewal
- Payment is charged to your Apple ID or Google account when you confirm the purchase.
- The subscription renews automatically at the same price for the same period unless you turn off auto-renewal at least 24 hours before the current period ends.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage the subscription and turn off auto-renewal at any time in your Apple ID settings or your Google Play account settings. Deleting the app does not cancel the subscription.
Refunds
Purchases are handled by Apple and Google, so refunds are theirs to give, under their own policies. We cannot issue refunds for purchases made through the App Store or Google Play. Where the law of your country gives you a right to withdraw or refund, that right stands regardless of this clause.
Fair use
Pro is generous but not unlimited: very heavy automated or commercial use is capped so the service stays fast and affordable for everyone. The limits are shown in the app, and almost no ordinary student will reach them.
10. Changes to the service
We improve Magic Tutor continually, and features may change or be withdrawn. If we make a change that materially reduces what a paid subscription gives you, we will tell you before it takes effect and you may cancel.
We may change these terms. If a change is significant we will tell you in the app or by email before it applies. Continuing to use Magic Tutor after that means you accept the new terms.
11. Ending it
You may stop using Magic Tutor at any time and delete your account. Deleting your account does not automatically cancel a subscription bought through Apple or Google — cancel that in the store as well.
We may suspend or close your account if you break these terms, if we are required to by law, or if we stop offering the service. If we close your account without cause while you have paid for a period you have not used, you may ask Apple or Google for a refund of the unused part.
12. No warranty
Magic Tutor is provided "as is". To the fullest extent the law allows, we make no warranties of any kind, and we do not promise the service will be uninterrupted, error-free, or that lessons will be accurate.
Nothing in these terms limits any right you have under the consumer law of your own country that cannot be limited by agreement.
13. Limits on our liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost data, lost profits, or for exam results, grades or academic outcomes.
Where we are liable, our total liability to you is limited to the amount you paid us in the 12 months before the claim arose, or US$50 if you paid nothing.
We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
14. Export and sanctions
By using Magic Tutor you confirm that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
15. Governing law
These terms are governed by the laws of the Republic of Iraq and the Kurdistan Region. Disputes will be heard by the competent courts of Erbil. If you are a consumer, this does not take away the protection of the mandatory laws of the country you live in, or your right to bring a claim there.
16. Apps downloaded from the Apple App Store
This clause applies only to the iOS app, and Apple requires it:
- These terms are between you and Magic Tutor AI only, not with Apple. Apple is not responsible for the app or its content.
- Your licence to use the app is limited to using it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide any maintenance or support for the app. Support questions go to support@magictutor.ai.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund your purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind.
- Magic Tutor AI, not Apple, is responsible for addressing any claim about the app, including product liability claims, any claim that the app fails to conform to a legal requirement, and claims under consumer protection or similar law.
- Magic Tutor AI, not Apple, is responsible for the investigation, defence, settlement and discharge of any third-party claim that the app infringes that party's intellectual property rights.
- You must comply with any applicable third-party terms when using the app.
- Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance, Apple will have the right to enforce these terms against you as a third-party beneficiary.
17. General
If any part of these terms is found unenforceable, the rest continues to apply. If we do not enforce a term straight away, we have not given up the right to enforce it later. You may not transfer your rights under these terms to anyone else; we may transfer ours if the service is sold or reorganised, provided your rights are not reduced.
These terms, together with the Privacy Policy, are the whole agreement between us about Magic Tutor.
